Indonesia Scandalous Movie Stars to be Charged under antiPorn Law

Although three celebrities believed to be involved in a series of sex videos may not have been the ones who spread them on the Internet, the trio may face charges of violating anti-porn law, police said on Sunday.

Officers from the National Police security and transnational affairs unit investigating the scandal that broke last week believe the three violated the law just by being involved in the videos, a police source told the Jakarta Globe.

“After a short interview with Ariel and Luna Maya on Friday, we are starting to focus our investigation based on Law No. 44/2008 on Pornography. We believe that they breached the law, even though so far there are no indications that they intentionally distributed these videos,” the source said.

He said Nazril “Ariel” Irham, the lead vocalist of the band Peterpan, would be investigated on suspicion of having violated Article 4 of the anti-pornography law that prohibits producing, creating, reproducing, copying, distributing, broadcasting, importing, exporting, offering, trading, renting or otherwise making available pornography.

Ariel allegedly produced and created the videos, the source said, adding that the ban also covered material intended for private consumption.

Those found guilty face up to 12 years in prison and fines of up to Rp 6 billion (RM2.13mil).

“We are still summoning several experts to prove our allegation that Ariel intentionally produced these videos,” he said.

Actresses and presenters Luna Maya and Cut Tari, the two women in the videos featuring Ariel, could also face the charge, under the same law, on modelling for pornography.

“We are on the way to proving that both of them, Ariel also, violated Article 8, which states that a person is prohibited from knowingly or consentingly being objects or models for pornographic content,” the source said. The charge carries up to 10 years in jail and fines of up to Rp 5 billion (RM1.77mil).

The National Police security and transnational affairs deputy chief, Comr. M Iriawan, said “the investigation is ongoing,” and declined further comment.

On Thursday, National Police chief of detectives Comr. Gen. Ito Sumardi said police were certain that it was the three celebrities, not look-alikes, who were involved in the videos that have been widely circulated online.

Meanwhile, Rudi Satrio, a legal expert at the University of Indonesia, said that if police could identify the actors in a pornographic video, “a producer and creator” could be charged with breaking the anti-pornography law.

On the possibility of charging them with Criminal Code violation of adultery, he said only Cut Tari could be charged as she was the only one married.

“But first, there must be an official complaint from [her] husband and it should be ascertained when this sexual activity happened. Did it happen before her marriage? If yes, it cannot be prosecuted.”

OC Kaligis, Ariel’s and Luna’s lawyer, said on Friday that his clients were “victims,” but he did not elaborate on whether this was because they were not the people in the videos or because the videos were distributed without their consent.

It is believed that the videos were taken from a computer hard drive lost by Ariel.

Indonesian police have charged Peterpan frontman Nazriel "Ariel" Irham under the country's strict Anti-Pornography Law.

National Police chief Gen. Ito Sumardi told journalists Tuesday that Ariel had been detained.

"He did not turn himself in but he was turned in by his lawyers on Tuesday morning. He is under arrest," Ito told Detik.com.

Ariel is the only suspect charged in relation to the production of three videos, two featuring current girlfriend and television presenter Luna Maya and a third starring Cut Tari, host of the popular 'Insert' gossip show.

Ito said Luna and Cut Tari, who is married, were still classified as witnesses.

He said that Ariel would had been charged under the Anti-Pornography Law. According to Chapter 29 of the law, anyone who produces, makes, disseminates, broadcasts, imports, exports, offers, sells, rents or provides pornography can face a minimum six month or maximum 12 year jail term.

Fines range from Rp 250 million (RM88,753 ) to Rp 6 billion (RM2.1million)

Police have yet have been able to determine how the graphic pornographic clips ended up being published on the Internet.

Ariel’s friend and former Peterpan keyboardist Andika also answered a police summons as witness on Tuesday.

"As a good citizen, I am answering the police invitation," Andika said.

He declined to comment on the videos. "I don’t know, I haven’t seen it yet," he said.

Messages of Support Flood in for ‘Peterporn’

Hundreds of messages of support have flooded in for Peterpan frontman Ariel in the wake of the developing explicit tapes scandal involving at least two celebrity starlets.

The messages come as the term Peterporn, used to describe Ariel, is the most popular for word on Twitter, an International social networking site.

Though Ariel does not have a listed Facebook profile and his twitter account is inactive, hundreds of fans — and a sprinkling of critics — have posted messages on Facebook’s Official Peterpan Band site.

One fan, identified as Mahesa Wonk, advised Ariel — who has not commented publicly on the videos that also allegedly feature model Cut Tari and his current girlfriend, Maya Luna, — to “keep going.”

“Nobody’s perfect, don’t worry about the video and keep on making music,” he wrote.

Linda Wardani said the videos were possibly leaked by people who were jealous of Ariel and his friends’ careers.

Rini Riyadi asked Ariel to clear the air by holding a news conference.

“Ariel, please hold a news conference. If you’re right, please talk to the media. Don’t run or hide, don’t let it develop into something uglier. I am so sad because there’s a new video and the man looks so much like you, Riel,” Rini wrote.

Not all comments were supportive and others were angry.

“Anyone who still supports Ariel means he or she also supports adultery, you’re all pro-adulterers, aren’t you? Luna, I thought your love [for Ariel] would end up in a marriage but it only ended up in an adultery in a seedy motel room. F**k for Ariel,” wrote Syech Puji, who has a poor grasp of the definition of adultery.

S e x between two consenting adults, including between men, is not illegal in Indonesia.

One commentator on the Jakarta Globe Facebook Web site was left wondering if Ariel’s private video collection had been stolen, while another said he’d heard that 34 other videos were in existence.

“Ariel is the successor of Edison Chen, I guess hahahaha... Rock on, dude!” wrote Globe Facebook fan Nino Chandra, in reference to the Hong Kong actor whose career folded after pornographic photographs and videos with himself and a Chinese celebrities Gillian Chung, Bobo Chan and Cecilia Cheung were leaked to the Internet in 2008.

Jakarta Police, meanwhile, say they are focusing their investigations on finding the people who published the graphic sex tapes on the Web and charging them under the Electronic Information and Transaction Law.

“We will investigate whether the video was leaked by other people or the people in the video themselves,” Jakarta Police Spokesman Sr. Comr. Boy Rafli Amar told Detik.com, adding that the police would not summon Ariel and Luna until they had finished investigating how the tape was leaked publicly.

Three Indonesian celebrities who allegedly appeared in s-e-x videos posted on the Internet will be questioned for possible breaches of a new antipornography law, police said Wednesday.

Two explicit clips widely circulated online this week appear to show popular singer Nazril Ariel having s-e-x with models and television presenters Luna Maya, his current girlfriend, and Cut Tari, his ex-girlfriend.

Chief police detective Ito Sumardi said the celebrities would be questioned about how the clips had appeared on the Internet.

"We will question them to find out about the clips and how the videos were circulated in public," Sumardi told reporters.

Maya is a goodwill ambassador for the United Nations World Food Programme and has appeared in advertisements with Ariel for a soap made by Anglo-Dutch food and cosmetics giant Unilever.

Tari meanwhile endorses Sharp air conditioners.

A spokesman for Unilever said the soap ads had been cancelled this week but denied the move was connected to the sextapes.

Producing or distributing sexually explicit material carries a maximum penalty of 12 years' jail under the tough anti-pornography law passed in the mainly Muslim country in 2008.

Muslim lawmakers have said the videos underline the need for tighter controls of the Internet in the country of 240 million people.

"There should be a heavy punishment for this crime," Communication and Information Minister Tifatul Sembiring said on his Twitter micro-blog account.

A spokesman said Vice President Boediono was concerned about the effect the videos would have on young people.

"He is deeply concerned about the negative impact these pornvideos could have on our children," Boediono's spokesman, Yopie Hidayat, told ElShinta radio.

The scandal has been among the top worldwide trending topics on Twitter under the "Peterporn" tag, a reference to Ariel's band, Peterpan. Several pages supporting Ariel have also appeared on social networking site Facebook.
